MitigateMurphy — Terms of Use

Last updated: 21/11/2025

These Terms govern your use of MitigateMurphy ("the App", "Service"). By using the App, you agree to these Terms.

1. Purpose of the App

MitigateMurphy is a check-in safety tool aimed at reducing risk by notifying emergency contacts when a user does not check in within their chosen timeframe. It is an additional layer of mitigation, intended primarily for situations where a user becomes unable to call for help.

The App does not replace emergency services, direct communication, or existing safety practices. Nothing works 100% of the time. If you are able to call emergency services or seek help directly, you should always do so. It is an assistance tool only.

2. User Responsibilities

  • You must provide accurate contact information.
  • You are responsible for ensuring your emergency contacts are aware they have been listed.
  • You must maintain your device’s functionality (battery, connectivity, OS updates) to ensure check‑ins operate correctly.
  • You must not misuse the App for harassment, false alerts, or any unlawful activity.

3. Limitations and Disclaimers

  • The App is provided "as is" without warranties of any kind.
  • We are not responsible for failure of notifications caused by device settings, connectivity loss, third‑party service outages, or incorrect user configuration.
  • The App is not a substitute for medical, emergency, or supervisory care.

4. Emergency Contact Notifications

When a check-in is missed, the App may notify your nominated emergency contacts via push notifications or other in-app channels. You authorise us to send such notifications on your behalf.

5. Account Termination

We may suspend or terminate accounts that:

  • Violate these Terms,
  • Abuse the service, or
  • Interfere with system security.

Users may terminate their account at any time.

6. Intellectual Property

All code, design, trademarks, and content associated with the App remain the property of MitigateMurphy. You are granted a limited, non‑exclusive licence to use the App.

7. Updates and Changes

We may modify the App or these Terms at any time. Continued use after changes indicates acceptance.

8. Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages.
  • Total liability in any claim is limited to the amount paid for the Service in the previous 12 months (if any).

9. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be resolved through the courts of New Zealand.
